1.1 We are quoting on the assumption that You are a “Consumer” as defined in Clause 3 below.

1.2 You may only accept the quotation if you are a “Consumer”. If You are not, the quotation will not be valid. In that case, please let Us know and We will try to provide a quotation for You as a non-Consumer”.

2. Information

2.1 We are required by the Regulations (as defined in Clause 3 below) to ensure that certain information is given or made available to You as a Consumer before We make our contract with You (i.e. before You accept the quotation) except where that information is already apparent from the context of the transaction. We have either included the information itself either in the quotation or these Terms and Conditions for You to see now, or We will ensure that We have made it available to You before You accept the quotation.

2.2 All of that required information and any other information We give You about the Goods or Ourselves which You take into account when deciding to accept the quotation or when making any other decision about the Goods  will, as required by the Regulations, be part of the terms of Our contract with You as a Consumer.

3. Interpretation

3.1 A “Consumer” means a consumer as defined in the Consumer Rights Act 2015, i.e. an individual who agrees to purchase and receives the Goods for their personal use and for purposes wholly or mainly outside the purposes of any Business.

3.2 A “Business” means any business, trade, craft, or profession carried on by You or any other person/organisation.

3.3 The “Regulations” means The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

3.4 A “business day” means any day other than a Saturday, Sunday or bank holiday.

3.5 The headings in these Terms and Conditions are for convenience only and will not affect their interpretation.

3.6 Words signifying the singular will include the plural and vice-versa.

4. Cancellation under the Regulations

4.1 In accordance with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if the Customer as a private consumer has (1) entered into this contract prior to a face-to-face meeting with Bearwood Campers or (2) the contract is agreed face-to-face with Bearwood Campers in a place that is not Bearwood Campers business premises or (3) the Customer places an order during a face-to-face meeting with Bearwood Campers that happens in a place that is not Bearwood Campers business premises or (4) the contract is entered into on Bearwood Campers business premises or through any means of distance communication immediately after a face-to-face meeting between Bearwood Campers and the Customer in a place that is not Bearwood Campers business premises, then the Customer may cancel the contract without giving any reason up to 14 days after the day upon which the Customer (or anyone on the Customer’s behalf) takes possession of the Goods.

4.2 In order to exercise the right to cancel the Customer must provide Bearwood Campers with a clear statement (e.g. a letter sent by post, fax or email). The statement should be sent to Bearwood Campers using the contact details contained within the order form within the 14-day cancellation period.

4.3 On cancellation Bearwood Campers will reimburse the Customer all payments received from the Customer excluding a charge of 10% of the purchase price, less any damage incurred from the date of collection.

4.4 The Customer shall return the Goods to Bearwood Campers without undue delay and in any event not later than 14 days after the day on which the Customer advises Bearwood Campers of the cancellation, at the Customer’s cost. If the Customer fails to return the Goods, Bearwood Campers may make a charge for the cost of recovering the Goods from the Customer, this is likely to cost a minimum of £250 and Bearwood Campers may deduct this charge from any sum that Bearwood Campers must reimburse to the Customer.

4.5 Bearwood Campers will reimburse the Customer using the same means of payment as the Customer used (unless otherwise agreed) without undue delay and in any event within 14 days after Bearwood Campers received the Goods back or, if earlier, 14 days after the day on which the Customer provides evidence that the Goods have been sent back.

4.6 On cancellation any related credit agreement or other ancillary contract will be cancelled. If the cancelled contract involved a part-exchange Bearwood Campers will at Bearwood Campers discretion either return the part-exchange or pay the agreed part-exchange value (after deduction of the sums paid by Bearwood Campers to settle any finance or other interests affecting the part-exchange vehicle) to the Customer. If the amount paid to settle any finance or other interest exceeds the part-exchange value of the Goods the Customer shall immediately reimburse Bearwood Campers on demand.

4.7 If the value of the Goods is diminished because of the Customer handling the Goods beyond what is necessary to establish the nature, characteristics and functioning of the Goods, Bearwood Campers may recover that amount from the Customer Bearwood Campers can deduct it from any reimbursement.  Bearwood Campers will normally view any alteration, modification or personalisation of the Goods or driving for in excess of 100 miles as going beyond what is necessary to establish to nature, characteristics and functioning of the Goods.

4.8 If the Goods are made to the Customer’s specifications or clearly personalised then the Customer does not have the right to cancel the contract. In view of the nature of the service, any order - once confirmed by the Company - is not cancellable. Cancellation of the Order by the Client will only be accepted on condition that any costs, charges and expenses already incurred, including any charges that will be levied by a sub-contractor on account of their expenses, work or cancellation conditions will be reimbursed to the Company forthwith.
